General

These general terms and conditions (“Terms” or “the Terms”) apply when you, as a customer, purchase a product via www.lewaofsweden.com (hereinafter referred to as “the Website”). An agreement is entered between you as the customer (“you” or “the customer”) and LEWA Of Sweden AB, organization number 559085-3072 (“LEWA”).

To place an order through the Website, you must be over 18 years of age and accept these Terms, which you do by completing your purchase. By accepting these Terms, you agree to abide by them and confirm that you have read the information regarding personal data and consented to the use of personal data and cookies in accordance with LEWA’s Privacy Policy.

A purchase agreement between you as the customer and LEWA is entered into when we have confirmed your order and you have received an order confirmation from us via email. We recommend that you, as a customer, save this order confirmation for any future contact with our customer service.

Persons under the age of 18 are not permitted to place orders on the Website. To place an order, you must verify your age. This is required because LEWA products are intended only for adults (18 years or older). We verify your age through our partners. Any order placed in another person’s name (identity fraud) or in any other way that may cause LEWA financial damage will be reported to the police. In cases of suspected irregularities or misuse of our ordering system, LEWA reserves the right to deny a purchase.

When placing an order, you will be asked to provide certain personal information, and you are responsible for ensuring that the information you provide is accurate and complete. Prices and Payment

When ordering via the Website, the prices listed on the Website apply. All prices are stated including VAT. You will find the various payment options during checkout. LEWA is entitled to charge payment at the time of order, unless invoice payment or another similar payment method has been selected by you and approved by LEWA. In the case of invoice or installment payments, LEWA or its partners may conduct a credit check. If a credit check is performed, you will be notified of this. LEWA reserves the right not to always offer all payment methods, or to change the payment method if the one you selected cannot be used at the time of purchase.

Discounts and Promotions

LEWA reserves the right to withdraw any discounts or promotions offered on the Website at any time. Offers on the Website are valid for a limited time and while supplies last.

Complaints

If you wish to report a defect in a product purchased from LEWA, please contact us as soon as possible after discovering the defect using the contact details provided on the Website (info@lewaofsweden.com). In handling complaints, we follow the guidelines established by the Swedish National Board for Consumer Disputes (ARN) (www.arn.se).

When submitting a complaint, please include the following information:

–  The email address used for the purchase

–  The order number

–  The name of the item you wish to return

–  The reason for the return

Once the returned product has been received and the complaint approved, LEWA will compensate you in accordance with applicable consumer protection legislation. LEWA reserves the right to deny a complaint if it turns out that the product is not defective according to applicable consumer protection laws. More information about your right to complain as a consumer can be found at www.konsumentverket.se.

LEWA always covers return shipping for approved complaints regarding damaged or defective goods. When the returned product has been received and the complaint approved, the customer will be compensated. LEWA’s liability is limited to the value of the product and any applicable return shipping costs. If the customer has already paid for the goods, and unless otherwise agreed between the parties, reimbursement will be made to the account charged at the time of purchase. Refunds are normally processed within 14 days.

LEWA reserves the right to deny a complaint if the product is not defective under applicable consumer protection laws. In cases where no defect can be demonstrated, a fee of SEK 299 including VAT will be charged to cover administrative, shipping, and handling costs related to the matter. Shipments lacking a return number will be sent back to the sender and shipping costs will be charged. The fee is invoiced with a payment term of 10 days net. In the event of late payment, a reminder fee of SEK 50 and interest on arrears will be added.

Returns

When you, as a consumer, purchase goods online, you usually have a 14-day right of withdrawal under the Swedish Distance and Off-Premises Contracts Act (2005:59). However, the right of withdrawal does not apply to purchases of products on lewaofsweden.com, as all of these products are perishable goods with a limited shelf life.

Force Majeure

LEWA is not responsible for delays caused by circumstances beyond LEWA’s control. This may include strikes, extreme weather conditions, terrorist attacks, or significant technical issues such as power, telecommunication, or data connection failures beyond LEWA’s control.

Products

Certain products may be available exclusively through our online store. These products may be available in limited quantities and are only eligible for return or exchange in accordance with our return policy.

We have made every effort to display our products as accurately as possible regarding color and images on the Website. However, we cannot guarantee that your computer or device display accurately reflects the colors.

We reserve the right, but are not obligated, to limit the sale of our products to any person, geographic region, or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products we offer. All descriptions of products or product pricing are subject to change at any time without notice. We reserve the right to discontinue any product at any time.

Errors, Inaccuracies, and Omissions

LEWA reserves the right for typographical errors that may occur on the Website, such as incorrect prices or stock information. If an incorrect price has been listed for a product you have ordered, LEWA will contact you to agree on how to proceed with the order. We assume no obligation to update, modify, or clarify information regarding third-party websites, except as required by law.

Other

LEWA reserves the right, in individual cases, to deny or change your order, for example if you have payment defaults or have provided incorrect personal details or information when placing your order.

The Website, including all its content, is owned by LEWA or its licensors and partners. The material on the Website is protected by intellectual property and marketing laws. This means that images, graphics, design, layout, and information about goods, services, and other content may not be copied or used without permission from LEWA. LEWA is not responsible for any information on the Website provided by third parties.

Amendments to the Terms

LEWA reserves the right to make changes to these Terms. Such changes will be published on the Website. Changes apply from the time you have accepted the Terms (in connection with a new purchase or visit to the Website). LEWA recommends that you regularly check the Website to stay informed of any updates to these Terms. Continued use of the Website after changes have been made constitutes acceptance of the revised Terms.

Invalidity

If a competent court, authority, or arbitration board finds that any provision of these Terms is invalid or unenforceable, such provision and all other provisions shall remain valid and enforceable to the extent permitted by applicable law. Provisions declared invalid or unenforceable will be replaced by relevant legal guidance and advice.

Applicable Law and Dispute Resolution

Disputes shall primarily be resolved through discussion with LEWA’s customer service.

If the dispute cannot be resolved in agreement with LEWA’s customer service, you as a customer can contact the Swedish National Board for Consumer Disputes (ARN), more information is available at www.arn.se

You can also file a complaint online via the EU Commission’s Online Dispute Resolution platform at ec.europa.eu/consumers/odr. If you submit a complaint through this platform, your case will automatically be forwarded to the appropriate national dispute resolution body, which will then contact us to attempt to resolve the matter without court involvement.

In case of a dispute, LEWA Of Sweden AB will follow the decisions of ARN or the relevant dispute resolution body. Disputes concerning the interpretation or application of these Terms shall be governed by Swedish law and decided as described above or, ultimately, by a general court.
